TERMS & CONDITIONS

Luxury Florida Vacation cannot accept responsibility for incorrect descriptions, errors or omissions.

We, and the owners, take all steps to maintain a good standard for our guests. We appreciate the care with which our guests treat the amenities provided in the holiday houses, but are aware that on occasions there have been instances of wilful damage. Guests are respectfully advised that owners may exercise their right to report malicious damage to the Police who can pursue criminal charges.

Please read the following Terms and Conditions carefully as payment by the required date of the accommodation tariff quoted, WILL CONFIRM YOUR ACCEPTANCE of these Terms & Conditions and the booking details.

If the guest and/or their visitors remain on the property after the booked departure time, they will be in breach of these conditions, will be deemed to be trespassing and the Summary Offences Act 1953 will be enforced.

1. WHEN AT THE PROPERTY

Provide general security in and around the property during the period of the holiday accommodation booking. Close and lock all doors and windows when leaving the property during your stay.

Ensure you or your guests do not make excessive noise or engage in conduct in or around the property that causes annoyance or harm to neighbours. All reports of excessive noise, unruly or threatening behaviour will be reported to the police and may result in eviction from the property.

Notify the Agent of all breakages, damage, and failure of electrical or plumbing equipment as soon as practicable. The cost of rectifying any such losses caused by the guest or their visitors may be charged accordingly. Attendance by caretaking/cleaning staff or tradespeople to address maintenance issues will depend on their availability.

Leave the property in a neat and tidy manner - REMOVE all rubbish, bottles, food and personal items. Wash and put away all dishes and re-make all beds. The cleaning fee paid at booking DOES NOT include the cleaning of ovens, dishwashers, stove tops, refrigerators and/or the removal of food items left there. Any such cleaning will incur an extra charge to the guest.

Securely lock the property at the time of departure.

Guests to supply bed sheets, pillowcases, kitchen linen, towels and the like, all personal hygiene and cleaning requirements (and wood if combustion fire advertised) for the duration of the booking (soap, toilet paper, detergents, cloths,

NO DOMESTIC PETS are permitted on or about the property during the term of the holiday accommodation booking, unless advised otherwise.

Smoking is prohibited in all holiday properties.

2. BOOKINGS

PLEASE NOTE: CHANGE IN BOOKING OPENING DATES: ALL properties are available to book SIX MONTHS in advance

All bookings are accepted by the Agent in good faith, but are subject to change or cancellation by the owner of the property prior to the commencement of the booking.

All on-line bookings require payment of the tariff and the Departure Guarantee (See 5. Departure Guarantee) by credit card at the time of booking.

A reservation will be held by the Agent for no more than 5 days (or otherwise noted within the 'payment' section), while awaiting receipt from the guest of the deposit/full tariff.

In the event the deposit/full tariff is not received after five days, the booking will be deemed to have lapsed, resulting in cancellation.

A FEE EQUIVALENT TO 50% OF THE DEPARTURE GUARANTEE (refundable bond) WILL BE CHARGED to guests who do not leave the property by the booked departure time. This fee will be charged by Luxury Florida Vacation against the Departure Guarantee.

3. PAYMENT

Deposit

The deposit will be 50% of the tariff, or the full tariff for the property, or $200, whichever is the higher amount, PLUS the cleaning fee.

For bookings made for periods of less than 7 days, and for bookings made less than 30 days in advance, payment of the full tariff is required within 5 days of the reservation being made.

The advised deposit or full tariff is payable by the guest to the Agent within 5 days of the date of the reservation being made, or as advised within the 'payment' section of the booking summary. If the payment is not received by said date, the booking will lapse.

The guest's payment of the deposit/full tariff will confirm their acceptance of these Terms and Conditions.

Balance of Payment

The balance of payment for the tariff is to be paid to the Agent not less than 30 days prior to the commencement of the booking.

If the balance is not paid 30 days prior to the commencement of the booking, the booking will lapse and the deposit will be forfeited.

Method of Payment

Cheques or money orders, made payable to Luxury Florida Vacation Trust Account, and posted to 8168 boat hook loop unit 727 Windermere, FL 34786

Quote reservation number provided in the Reservation Documentation for all correspondence.

Credit card payment - Visa or MasterCard - will be accepted. A surcharge of 1.95% (including GST) will apply to all credit card payments.

4. CANCELLATION

Cancellation by the guest MUST be advised IN WRITING to the Agent prior to commencement of the booking.

Monies paid by the guest will not be refunded UNLESS the property is re-let for the same period. NO money will be refunded if the property is NOT re-let for the same period. A refund will incur AN ADMINISTRATION FEE OF $110 (Inc. GST).

If a cancellation occurs as a result of the actions of the property owner, Clause 4 of these Conditions will not apply. If such a cancellation occurs, the Agent will make reasonable attempts to secure alternative accommodation for the guest. If no alternative accommodation can be secured, all monies paid by the guest will be refunded in full.

5. DEPARTURE GUARANTEE (DG)

At the time of booking, Dodd & Page requires pre-authorisation to debit the guest's CREDIT CARD with an amount to cover costs for any breakages, repairs, rubbish removal and/or extra cleaning, to a maximum of $1,000. This is termed a "Departure Guarantee".

This pre-authorised transaction will be debited if the property is deemed to be left with rubbish requiring removal or repairs are required and/or if extra cleaning (other than what has been paid) is needed please refer to Section 2 above.

A FEE EQUIVALENT TO 50% OF THE DEPARTURE GUARANTEE (refundable bond) WILL BE CHARGED to guests who do not leave the property by the booked departure time. This fee will be charged by Dodd & Page against the Departure Guarantee.

The guest's pre-authorisation for Luxury Florida Vacation to debit their credit card will be effective for a period of 7 days following departure.

If the guest does not have access to a credit card, the DG amount is to be lodged by cheque, money order or cash with the Agent no later than 10 days prior to the reservation arrival date. This amount will be refunded to the guest by cheque, less any cleaning, rubbish removal or repair costs, 7-10 days after they depart the property.

Occasionally the cost of repairing property damage or cleaning and rubbish removal is greater than the lodged Departure Guarantee.  When this occurs the agent will contact the guest to advise the extra payment required.  Guests are respectfully advised that owners may seek recovery through the Small Claims Court of unpaid costs for damage or cleaning that are in excess of the Departure Guarantee amount.

6. OCCUPANCY AND TERM OF BOOKING

The guest acknowledges:

The term of the holiday booking will start at 2.00 p.m. on the booked arrival date, and will cease at 11 a.m. on the booked departure date, unless specifically noted otherwise within the guest's Reservation Documentation.

If the guest enters the property before the said arrival time, or remains on the property after the said departure time, they are in breach of these conditions and will be deemed to be trespassing (Summary Offences Act 1953).

The occupiers of the property will be those guests nominated on the booking request. Occupiers of the property who are not the booked guests will be required to leave.

The property is booked for private holiday use and NOT for commercial purposes, parties, receptions or the like.

More persons than are booked at the date of reservation will NOT be permitted to reside in the property.

No tent, annexe, caravan or other temporary accommodation will be permitted at the property during the booking.

7. KEYS

If keys are LOST or MISPLACED by the guest, the Agent reserves the right to charge a call-out fee for after-hours attendances and for key replacements. Unforeseen circumstances after hours may require a locksmith at the guest's expense.

Proof of confirmed holiday booking (receipt or Reservation Documentation) together with payment for the locksmith, will be required at the time.

8. AFTER HOURS CONTACT

Between 5 p.m. and 7 p.m. Monday to Friday, 12 noon – 7 p.m. Saturday, or 9 a.m. – 7 p.m. Sunday and Public Holidays, guests can ring the after-hours number that is quoted on the answering service on 407-433-4772, to report key/access problems or URGENT MAINTENANCE ISSUES ONLY that require IMMEDIATE attention.
